Frequently Asked Questions California Employment Law

Do I have a case if my employer treated me unfairly?

Unfair treatment alone is not always illegal. However, you may have a case if the conduct involved discrimination based on a protected characteristic, retaliation for reporting misconduct or requesting accommodations, harassment or a hostile work environment, or wrongful termination. California law provides strong protections for employees.

What qualifies as retaliation under California law?

Retaliation occurs when an employer punishes an employee for engaging in protected activity such as reporting harassment or discrimination, requesting medical leave or disability accommodations, complaining to HR or management, or filing a legal claim.

Can my employer fire me for asking for accommodations?

No. Under California law, employers must engage in a good-faith interactive process, provide reasonable accommodations when possible, and avoid retaliating against employees who request them.

What is a hostile work environment?

A hostile work environment exists when harassment is severe or pervasive, based on a protected characteristic, and interferes with the employee’s ability to work.

Do I need to quit to have a case?

No. Many claims arise while employment is ongoing. If working conditions become intolerable and force a resignation, it may qualify as constructive termination.

Can I be forced into arbitration?

Not always. Arbitration agreements must be clearly communicated, mutually agreed upon, and lawful to be enforceable.

General Questions

How much does it cost to speak with a lawyer?

Consultations are confidential. Personal injury cases are typically handled on a contingency basis, meaning no legal fees unless compensation is recovered.

What should I do before contacting a lawyer?

Write down what happened, save relevant documents, avoid discussing the case with insurance adjusters or HR without advice, and seek medical care if injured.
